١. مقدمة عامة ونطاق التطبيق 1. Introduction and Scope

يلتزم تطبيق "أثير الإنجليزية" (Atheer English) ("أثير"، "نحن"، "الخاص بنا") بحماية خصوصية مستخدميه امتثالاً تاماً لنظام حماية البيانات الشخصية الصادر بالمرسوم الملكي رقم (م/١٩) ولوائحه التنفيذية ("نظام حماية البيانات الشخصية")، وتوجيهات الهيئة السعودية للبيانات والذكاء الاصطناعي ("سدايا")، وإرشادات مراجعة متجر تطبيقات أبل. توضح سياسة الخصوصية هذه كيفية جمع بياناتك الشخصية، واستخدامها، واستضافتها، والإفصاح عنها، وحمايتها عند استخدامك لتطبيق وموقع أثير الإنجليزية (يُشار إليها مجتمعة باسم "الخدمة"). باستخدامك للخدمة، فإنك تقر بأنك قرأت وفهمت سياسة الخصوصية هذه. إذا كنت لا توافق على هذه السياسة، يرجى عدم استخدام الخدمة. Atheer English ("Atheer", "we", "us", or "our") is committed to protecting your privacy in full compliance with the Saudi Personal Data Protection Law issued by Royal Decree No. (M/19) and its Implementing Regulations ("PDPL"), the guidance of the Saudi Data & AI Authority ("SDAIA"), and the Apple App Store Review Guidelines. This Privacy Policy explains how we collect, use, host, disclose, and protect your personal data when you use the Atheer English mobile application and website (collectively, the "Service"). By using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Policy, please do not use the Service.

٢. البيانات التي نجمعها وأغراض جمعها 2. Data We Collect and Processing Purposes

نجمع فقط الحد الأدنى من البيانات الشخصية اللازمة لتقديم وتطوير خدماتنا التعليمية: We collect only the minimum personal data necessary to provide and improve our educational services:

• بيانات الحساب: الاسم، عنوان البريد الإلكتروني، وكلمة المرور المشفرة. تُسخدم لإنشاء حسابك وتأمينه. Account Information: Name, email address, and an encrypted password, used to create and secure your profile.
• التسجيلات الصوتية وبيانات النطق (الميكروفون): يتطلب التطبيق إذناً صريحاً للوصول للميكروفون لمعالجة نطقك للكلمات والجمل. يتم معالجة الصوت والتعرف على النطق محلياً بالكامل على جهازك (On-Device Processing via Whisper)؛ ولا يتم رفع أو نقل أو تخزين أي ملفات صوتية أو تسجيلات على خوادم خارجية أو مشاركتها مع أطراف ثالثة. تُستخدم البيانات الصوتية حصرياً لهذا الغرض التعليمي — ولا تُستخدم أبداً للتعرف البيومتري أو التحقق من هويتك، ولا تُستخدم للإعلانات أو تكوين ملف تعريفي، ولا تُباع أو تُشارك مع أطراف ثالثة. Voice & Microphone Data: With your explicit permission, the app accesses your microphone. Pronunciation feedback is processed entirely locally on your device (On-Device Speech Processing via local Whisper model). No voice recordings or audio files are transmitted to, stored on, or shared with external servers. Voice data is used exclusively for this pedagogical purpose — it is never used for biometric identification or verification of your identity, and it is not used for advertising, profiling, or sold or shared with third parties.
• بيانات التقدم التعليمي: الكلمات والدروس المنجزة، دقة المفردات، نتائج الاختبارات، وإحصاءات الاستخدام، وتُستخدم لمتابعة وعرض تقدمك التعليمي. Educational Progress Data: Completed lessons, vocabulary accuracy, test scores, and usage statistics, used to track and display your learning progress.
• البيانات التقنية وبيانات التشخيص: عنوان IP، طراز الجهاز، نظام التشغيل، والمعرفات الفريدة للجهاز، ويتم جمعها لصيانة التطبيق وحل الأخطاء وتحسين تجربة المستخدم. Technical & Diagnostics Data: IP address, device model, operating system, and unique device identifiers, collected to maintain the app, debug errors, and improve user experience.

٣. خصوصية الأطفال وموافقة الوالدين 3. Children's Privacy and Parental Consent

يمكن استخدام تطبيق أثير الإنجليزية من قِبل المتعلمين دون سن ١٨ عاماً، بما يتوافق مع شروط الاستخدام الخاصة بنا. نحن نولي عناية إضافية لحماية البيانات الشخصية للقصر: Atheer English may be used by learners under the age of 18, consistent with our Terms of Use. We take additional care to protect the personal data of minors:

• لا يجوز للمستخدمين الذين تقل أعمارهم عن ١٨ عاماً استخدام الخدمة إلا تحت إشراف وبموافقة يمكن التحقق منها من الوالد أو الوصي القانوني، ويتم الحصول عليها عند إنشاء الحساب. Users under the age of 18 may only use the Service under the supervision and with the verifiable consent of a parent or legal guardian, obtained at account creation.
• عندما يُعرّف المستخدم نفسه بأنه أقل من ١٨ عاماً أثناء التسجيل، يتطلب التطبيق تأكيداً بأن أحد الوالدين أو الوصي القانوني قد راجع سياسة الخصوصية هذه وأذن بجمع بيانات حساب القاصر، والبيانات الصوتية، والتقدم التعليمي قبل تفعيل الحساب. Where a user identifies as under 18 during registration, the app requires confirmation that a parent or legal guardian has reviewed this Privacy Policy and authorized the collection of the minor's account, voice, and educational progress data before the account becomes active.
• يجوز لأحد الوالدين أو الوصي القانوني مراجعة البيانات الشخصية لطفله، أو طلب نسخة منها، أو طلب حذفها في أي وقت عبر التواصل معنا على admin@atheerapp.com. وسنتحقق من صلة مقدم الطلب بالطفل قبل اتخاذ أي إجراء. A parent or legal guardian may review, request a copy of, or request deletion of their child's personal data (including voice recordings) at any time by contacting admin@atheerapp.com. We will verify the requester's relationship to the child before acting on the request.
• نحن لا نجمع عن علم بيانات شخصية من القاصرين تزيد عن الحد الضروري للأغراض التعليمية الموضحة في هذه السياسة، ولا نستخدم بيانات القاصر لأغراض الدعاية أو التسويق. We do not knowingly collect more personal data from a minor than is necessary for the educational purposes described in this Policy, and we do not use a minor's data for advertising or marketing purposes.
• إذا علمنا أننا جمعنا بيانات شخصية من طفل دون الحصول على موافقة الوالدين المناسبة، فسنقوم بحذف تلك البيانات على الفور. If we learn that we have collected personal data from a child without appropriate parental consent, we will delete that data promptly.

٤. الأساس النظامي لمعالجة البيانات 4. Legal Basis for Processing

بموجب نظام حماية البيانات الشخصية (PDPL)، نعالج بياناتك الشخصية استناداً إلى الأسس النظامية التالية: Under the PDPL, we process your personal data on the following legal bases:

• الموافقة الصريحة: للوصول إلى الميكروفون ومعالجة التسجيلات الصوتية، ولحسابات القصر كما هو موضح في القسم ٣. يمكن سحب الموافقة في أي وقت عن طريق تعطيل أذونات الميكروفون في إعدادات جهازك أو عن طريق الاتصال بنا. Explicit Consent: For accessing the microphone and processing voice recordings, and for the account of a minor as described in Section 3. Consent may be withdrawn at any time by disabling microphone permissions in your device settings or by contacting us.
• تنفيذ العقد: لمعالجة بيانات الحساب وسجل التقدم التعليمي لتقديم تجربة تعلم أثير الإنجليزية وتفعيل أي اشتراكات تشتريها. Performance of a Contract: For processing account credentials and educational progress data to deliver the Atheer English learning experience and any subscriptions you purchase.
• الالتزام النظامي: عندما تكون المعالجة ضرورية للامتثال لالتزام يفرضه القانون السعودي أو جهة تنظيمية مختصة. Legal Obligation: Where processing is necessary to comply with an obligation imposed by Saudi law or a competent authority.

٥. الاحتفاظ بالبيانات 5. Data Retention

نحتفظ بالبيانات الشخصية فقط للفترة اللازمة لتحقيق الأغراض الموضحة في هذه السياسة: We retain personal data only for as long as necessary to fulfill the purposes described in this Policy:

• يتم الاحتفاظ ببيانات الحساب، والتقدم التعليمي، والبيانات التقنية طالما كان حسابك نشطاً، ول فترات معقولة بعد ذلك لدعم استرداد الحساب والامتثال للالتزامات القانونية أو المحاسبية أو التنظيمية. Account, educational progress, and technical data are retained for as long as your account remains active, and for a reasonable period thereafter to support account recovery and comply with legal, accounting, or regulatory obligations.
• يتم الاحتفاظ بالتسجيلات الصوتية فقط للمدة اللازمة لتوليد وتقديم تقييم النطق، وبعد ذلك يتم حذفها تلقائياً من الأنظمة، ما لم تختر حفظ تسجيلات معينة داخل التطبيق لمراجعة تقدمك الخاص (مع العلم أنها تعالج محلياً بالكامل على جهازك). Voice recordings are retained only for as long as needed to generate and deliver pronunciation feedback, after which they are automatically deleted from active systems, unless you have chosen to save specific recordings within the app for your own progress review.
• عند حذف الحساب، يتم مسح البيانات وفقاً للجداول الزمنية الموضحة في القسم ١٠. Upon account deletion, data is erased in accordance with the timelines described in Section 10.

٦. مكان تخزين البيانات والأمن السيبراني في المملكة العربية السعودية 6. Data Residency & Cybersecurity in Saudi Arabia

تماشياً مع اللوائح الوطنية وتوجيهات الهيئة السعودية للبيانات والذكاء الاصطناعي (سدايا): Consistent with national regulations and SDAIA guidance:

• يتم تخزين ومعالجة جميع البيانات الشخصية، والتقدم التعليمي، والملفات الصوتية بشكل آمن بالكامل على خوادم سحابية تقع بالكامل داخل المملكة العربية السعودية. All personal information, educational history, and audio files are securely stored and processed on cloud servers located entirely within the Kingdom of Saudi Arabia.
• نطبق تدابير حماية فنية وتنظيمية قوية، بما في ذلك تشفير البيانات أثناء النقل (TLS) وعند التخزين (AES-256)، بالإضافة إلى ضوابط الوصول والمراجعات الأمنية الدورية، لمنع الوصول غير المصرح به أو الفقدان أو الإفصاح. We implement strong technical and organizational safeguards, including Transport Layer Security (TLS) for data in transit and Advanced Encryption Standard (AES-256) for data at rest, together with access controls and regular security reviews, to prevent unauthorized access, loss, or disclosure.

٧. مقدمو الخدمات من الأطراف الثالثة 7. Third-Party Service Providers

نحن لا نبيع أو نؤجر أو نتاجر ببياناتك الشخصية أو ملفاتك الصوتية مع أطراف ثالثة لأغراض تجارية أو تسويقية. لتشغيل الخدمة، قد نشارك بيانات شخصية محدودة مع مقدمي خدمات معتمدين يعملون نيابة عنا (مثل مزودي الاستضافة السحابية والبنية التحتية الموجودين داخل المملكة العربية السعودية)، والملتزمين تعاقدياً بحماية بياناتك ومعالجتها فقط للأغراض التي نحددها. نحن لا نفوض هؤلاء المزودين باستخدام بياناتك لأغراضهم الخاصة. قد نفصح عن البيانات الشخصية عندما يطلب ذلك بأمر قضائي أو من قِبل جهة إنفاذ قانون أو سلطة تنظيمية مختصة داخل المملكة العربية السعودية. We do not sell, rent, or trade your personal data or audio files to third parties for commercial or marketing purposes. To operate the Service, we may share limited personal data with vetted service providers acting on our behalf (such as cloud hosting and infrastructure providers located within the Kingdom of Saudi Arabia), who are contractually bound to protect your data and to process it only for the purposes we specify. We do not authorize these providers to use your data for their own purposes. We may disclose personal data where required by a court order or a competent law enforcement or regulatory authority within the Kingdom of Saudi Arabia.

٨. حقوق صاحب البيانات الشخصية 8. Rights of the Data Subject

بموجب نظام حماية البيانات الشخصية، يمكنك (أو لوالد القاصر أو وصيه القانوني) ممارسة الحقوق التالية في أي وقت عبر الاتصال بنا: Under the PDPL, you (or, for a minor, their parent or legal guardian) may exercise the following rights at any time by contacting us:

• حق العلم/المعرفة: معرفة البيانات التي نجمعها وكيفية معالجتها، كما هو موضح في هذه السياسة. Right to be Informed: To know what data we collect and how we process it, as described in this Policy.
• حق الوصول: الحصول على نسخة من بياناتك الشخصية المحفوظة لدينا. Right of Access: To obtain a copy of your personal data held by us.
• حق التصحيح: طلب تصحيح أو استكمال البيانات غير الدقيقة أو الناقصة. Right to Correction: To request correction or completion of inaccurate or incomplete data.
• حق الإتلاف/الحذف: طلب حذف بياناتك الشخصية نهائياً عندما لا نعود بحاجة إليها أو عند سحب موافقتك. Right to Destruction/Erasure: To request permanent deletion of your data when it is no longer needed or where consent has been withdrawn.
• حق سحب الموافقة: سحب موافقتك على معالجة البيانات مستقبلاً (مثل الوصول إلى الميكروفون) في أي وقت. Right to Withdraw Consent: To withdraw consent for future processing, such as microphone access, at any time.
• حق تقديم شكوى: إذا كنت تعتقد أن بياناتك تمت معالجتها بشكل مخالف للنظام، فيحق لك تقديم شكوى إلى الهيئة السعودية للبيانات والذكاء الاصطناعي (سدايا) بصفتها الجهة التنظيمية المختصة، بالإضافة إلى الاتصال بنا مباشرة. Right to Lodge a Complaint: If you believe your data has been processed unlawfully, you have the right to file a complaint with the Saudi Data & AI Authority (SDAIA) as the competent regulatory authority, in addition to contacting us directly.

٩. الإشعار بتسريب البيانات 9. Data Breach Notification

نحن نتبع إجراءات داخلية لرصد والتحقيق في والاستجابة لأي حادث أمني يؤثر على البيانات الشخصية. وفي حال حدوث تسريب للبيانات يشكل خطراً على حقوقك أو مصالحك، فسنقوم بإشعار الجهة المختصة والمستخدمين المتأثرين دون تأخير غير مبرر، وفقاً للجداول الزمنية والمتطلبات المحددة في نظام حماية البيانات الشخصية ولوائحه التنفيذية. We maintain internal procedures to detect, investigate, and respond to any security incident affecting personal data. In the event of a data breach that poses a risk to your rights or interests, we will notify the competent authority and affected users without undue delay, in accordance with the timelines and requirements of the PDPL and its Implementing Regulations.

١٠. حذف الحساب وإتلاف البيانات نهائياً (إرشادات أبل 5.1.1) 10. Account Deletion & Permanent Erasure (Apple Guideline 5.1.1)

امتثالاً لإرشادات مراجعة متجر تطبيقات أبل (المادة 5.1.1)، يمكنك حذف حسابك وجميع البيانات الشخصية المرتبطة به نهائياً في أي وقت باستخدام خيار "حذف الحساب" في إعدادات التطبيق، أو عن طريق تقديم طلب إلى admin@atheerapp.com. In compliance with Apple App Store Review Guideline 5.1.1, you may permanently delete your account and all associated personal data at any time using the "Delete Account" option in the App Settings, or by submitting a request to admin@atheerapp.com.

• عند تأكيد حذف الحساب، نقوم بإزالة وحذف كامل بياناتك (الاسم، البريد الإلكتروني، وسجل التعلم) بشكل نهائي وغير قابل للاسترداد من خوادمنا النشطة ومن النسخ الاحتياطية خلال مدة أقصاها ١٤ يوم عمل. علماً بأن التسجيلات الصوتية لا تُخزن لدينا أساساً كونها تعالج محلياً على جهازك. Upon account deletion, all personal files, learning records, and credentials are permanently purged from active systems and backups within 14 business days. Note that audio recordings are never stored on our servers since they are processed entirely on-device. This process is irreversible.

١١. التعديلات على هذه السياسة 11. Changes to this Policy

قد نقوم بتحديث سياسة الخصوصية هذه من وقت لآخر لتعكس التغييرات في ممارساتنا أو القوانين المعمول بها. وإذا أجرينا تغييرات جوهرية، فسنقوم بإشعارك عبر التطبيق و/أو البريد الإلكتروني، وتحديث تاريخ "آخر تحديث" أعلاه قبل سريان التغييرات. استمرارك في استخدام الخدمة بعد تاريخ السريان يعد موافقة منك على السياسة المعدلة. We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. If we make material changes, we will notify you through an in-app notice and/or by email, and update the "Last updated" date above, before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Policy.
