١. قبول شروط الخدمة والأهلية 1. Acceptance of Terms and Eligibility

بوصولك إلى تطبيق "أثير الإنجليزية" (Atheer English) ("الخدمة") أو استخدامه، فإنك تقر بأنك قرأت شروط الاستخدام هذه ("الشروط") وفهمتها ووافقت على الالتزام بها. إذا كنت لا توافق على هذه الشروط، يرجى التوقف فوراً عن استخدام الخدمة. يجب أن تكون بعمر ١٨ عاماً ميلادياً على الأقل لإنشاء حساب وإدارته دون إشراف. إذا كنت دون سن ١٨ عاماً، فلا يجوز لك استخدام الخدمة إلا تحت الإشراف والموافقة الصريحة من أحد الوالدين أو الوصي القانوني، كما هو موضح بالتفصيل في القسم ٢. By accessing or using the Atheer English application (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please immediately cease using the Service. You must be at least 18 Gregorian calendar years of age to create and manage an account without supervision. If you are under 18 years of age, you may only use the Service under the explicit supervision and consent of a parent or legal guardian, as further described in Section 2.

٢. الأطفال وموافقة الوالدين (إرشادات أبل 1.3) 2. Children and Parental Consent (Apple Guideline 1.3)

عندما يكون عمر المستخدم دون ١٨ عاماً، يجب على أحد الوالدين أو الوصي القانوني مراجعة هذه الشروط وسياسة الخصوصية الخاصة بنا وتقديم موافقة يمكن التحقق منها قبل تفعيل حساب القاصر، بما في ذلك الموافقة على جمع ومعالجة تسجيلات صوت القاصر لتقديم تقييم النطق. ويظل أحد الوالدين أو الوصي القانوني مسؤولاً عن استخدام القاصر للخدمة، ويجوز له مراجعة بيانات القاصر أو طلب حذفها في أي وقت عبر التواصل على admin@atheerapp.com، كما يجوز له سحب الموافقة في أي وقت، مما سيؤدي إلى تعليق حساب القاصر. نحن لا نسمح عن علم للقاصرين باستخدام الخدمة دون موافقة أولياء أمورهم، ولا نوجه إعلانات سلوكية للقاصرين. Where a user is under 18 years of age, a parent or legal guardian must review these Terms and our Privacy Policy and provide verifiable consent before the minor's account is activated, including consent to the collection and processing of the minor's voice recordings for pronunciation feedback. A parent or legal guardian remains responsible for the minor's use of the Service, may review or request deletion of the minor's data at any time by contacting admin@atheerapp.com, and may withdraw consent at any time, which will result in suspension of the minor's account. We do not knowingly permit a minor to use the Service without such parental consent, and we do not direct behavioral advertising at minors.

٣. تسجيل حساب المستخدم والأمان 3. User Account Registration and Security

عند إنشاء حساب، يجب عليك تزويدنا بمعلومات دقيقة وكاملة ومحدثة. أنت مسؤول عن الحفاظ على سرية بيانات اعتماد تسجيل الدخول الخاصة بك وعن جميع الأنشطة التي تحدث بموجب حسابك. يجب عليك إخطارنا فوراً عند اكتشاف أي خرق للأمان أو استخدام غير مصرح به لحسابك. When creating an account, you must provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately upon discovering any breach of security or unauthorized use of your account.

٤. الاشتراكات، المدفوعات، التجديد التلقائي، واستعادة المشتريات (إرشادات أبل 3.1.2) 4. Subscriptions, Payments, Auto-Renewal, and Restoring Purchases (Apple Guideline 3.1.2)

يوفر تطبيق أثير الإنجليزية اشتراكات مدفوعة تتيح الوصول إلى مصادر تعليمية ممتازة، وتخضع للشروط التالية: Atheer English offers paid subscriptions providing premium learning resources, subject to the following terms:

• يتم تحصيل مدفوعات الاشتراك من حساب iTunes/Apple ID الخاص بك عند تأكيد الشراء. Subscription payments are charged to your iTunes/Apple ID account at confirmation of purchase.
• يتجدد الاشتراك تلقائياً بنفس السعر ولنفس الفترة (أسبوعي، شهري، أو سنوي) ما لم يتم إيقاف التجديد التلقائي قبل ٢٤ ساعة على الأقل من نهاية فترة الفوترة الحالية. Subscriptions automatically renew at the same rate and for the same period (weekly, monthly, or annually) unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• سيتم محاسبة حسابك للتجديد خلال ٢٤ ساعة قبل نهاية الفترة الحالية، وسيتم تحديد تكلفة التجديد في ذلك الوقت. Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified at that time.
• يمكنك إدارة اشتراكك وإيقاف التجديد التلقائي في أي وقت بعد الشراء بالانتقال إلى إعدادات حساب App Store الخاص بك. You can manage your subscription and turn off auto-renewal at any time after purchase by going to your App Store Account Settings.
• إذا قمت بإعادة تثبيت التطبيق أو تغيير الأجهزة، يمكنك استعادة الاشتراكات غير الاستهلاكية التي تم شراؤها مسبقاً دون أي رسوم إضافية باستخدام خيار "استعادة المشتريات" المتاح في إعدادات حساب التطبيق. If you reinstall the app or switch devices, you may restore previously purchased, non-consumable subscriptions at no additional charge using the "Restore Purchases" option available in the app's account settings.
• تتم معالجة جميع المعاملات المالية وطلبات استرداد الأموال حصرياً بواسطة شركة Apple وفقاً لسياسات الدفع الخاصة بها. نحن لا نقوم بمعالجة عمليات استرداد الأموال مباشرة؛ ولا نقدم أي تعويض عن الفترات غير المستخدمة من الاشتراك النشط. All billing transactions and refund requests are handled exclusively by Apple in accordance with Apple's payment policies. We do not process refunds directly; no refund is provided by us for unused portions of an active subscription period.

يخضع الاتفاق التعاقدي بينك وبين أثير الإنجليزية لاستخدام التطبيق لاتفاقية ترخيص المستخدم النهائي القياسية للتطبيقات المرخصة من Apple، والتي يمكن الوصول إليها عبر الرابط الرسمي لاتفاقية أبل (EULA). The contractual agreement between you and Atheer English regarding use of the app is governed by Apple's Standard Licensed Application End User License Agreement, accessible at Apple's Standard EULA Agreement.

٥. الملكية الفكرية والترخيص المحدود 5. Intellectual Property and Limited License

إن تطبيق أثير ومحتواه الأصلي — بما في ذلك النصوص، القصص التفاعلية، التسجيلات الصوتية، الرمز البرمجي، الهوية التجارية، والرسومات — هو ملكية فكرية حصرية لمالكي أثير ومحمي بموجب قوانين الملكية الفكرية في المملكة العربية السعودية والمعاهدات الدولية المعمول بها. نحن نمنحك ترخيصاً شخصياً، غير حصري، وغير قابل للتحويل، وقابل للإلغاء لاستخدام التطبيق لأغراض التعلم الشخصي غير التجاري فقط. ويُمنع منعاً باتاً الاستغلال التجاري للمحتوى أو نسخه. The Atheer app and its original content — including text, interactive stories, audio recordings, software code, branding, and graphics — is the exclusive intellectual property of the owners of Atheer and is protected by the intellectual property laws of the Kingdom of Saudi Arabia and applicable international treaties. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial learning purposes only. Commercial exploitation or copying of the content is strictly prohibited.

٦. الاستخدام المقبول والأنشطة المحظورة 6. Acceptable Use and Prohibited Activities

عند استخدام الخدمة، فإنك توافق على عدم: When using the Service, you agree not to:

• استخدام أدوات كشط البيانات، أو التنقيب عنها، أو استخراجها لجمع القصص التعليمية أو البيانات من التطبيق. Use data scraping, mining, or extraction tools to gather educational stories or data from the app.
• فك ترميز البرمجيات، أو محاولة هندستها عكسياً، أو محاولة استخلاص الكود المصدري للتطبيق أو أنظمة التعرف على الصوت الخاصة به. Decompile, reverse engineer, or attempt to derive the source code of the app or its voice recognition systems.
• مشاركة بيانات اعتماد حسابك الشخصي مع مستخدمين آخرين لتجاوز حدود الاشتراك النشط. Share your personal account credentials with other users to bypass active subscription boundaries.
• رفع ملفات أو برمجيات خبيثة أو محاولة تعطيل البنية التحتية لخوادمنا وشبكاتنا. Upload malicious scripts or attempt to disrupt the infrastructure of our servers and networks.

٧. حذف الحساب وإنهاء الخدمة (إرشادات أبل 5.1.1) 7. Account Deletion and Service Termination (Apple Guideline 5.1.1)

يحق لك التوقف عن استخدام الخدمة وطلب حذف حسابك وبياناتك نهائياً في أي وقت، عبر خيار "حذف الحساب" في إعدادات التطبيق أو بمراسلتنا على admin@atheerapp.com. كما تحتفظ أثير بالحق في تعليق أو إنهاء وصولك للخدمة، دون إشعار مسبق، في حال انتهاك هذه الشروط أو ارتكاب سلوك غير قانوني. You have the right to stop using the Service and to request permanent deletion of your account and data at any time, via the "Delete Account" option in the app settings or by emailing admin@atheerapp.com. Atheer also reserves the right to suspend or terminate your access, without prior notice, for breach of these Terms or unlawful conduct.

٨. إخلاء المسؤولية وحدودها 8. Disclaimer and Limitation of Liability

تُقدّم الخدمة على أساس "كما هي" و"حسب توفرها". نحن لا نضمن استمرارية الخدمة دون انقطاع أو الدقة المطلقة لأدوات تقييم النطق بالتعرف الصوتي، ولا نضمن نتائج طلاقة اللغة دون جهد دراسي شخصي. The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability of the Service or absolute grading accuracy of our voice recognition tools, and we do not guarantee fluency outcomes without personal study effort.

لا يوجد في هذه الشروط ما يهدف إلى استبعاد أو تقييد أي مسؤولية لا يمكن استبعادها أو تقييدها قانوناً بموجب أنظمة المملكة العربية السعودية، بما في ذلك لوائح حماية المستهلك المعمول بها. ومع مراعاة هذا القيد، وإلى أقصى حد يسمح به القانون المعمول به، تقتصر مسؤوليتنا الإجمالية الناشئة عن الخدمة أو المتعلقة بها على المبلغ الذي دفعته فعلياً مقابل الخدمة خلال الاثني عشر (١٢) شهراً السابقة للمطالبة. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under the laws of the Kingdom of Saudi Arabia, including applicable consumer protection regulations. Subject to that limitation, and to the maximum extent permitted by applicable law, our total liability arising out of or relating to the Service is limited to the amount you actually paid for the Service in the twelve (12) months preceding the claim.

٩. القوة القاهرة 9. Force Majeure

لن نكون مسؤولين عن أي فشل أو تأخير في الأداء ناتج عن أسباب خارجة عن إرادتنا المعقولة، بما في ذلك الكوارث الطبيعية، أو الإجراءات الحكومية، أو أعطال الإنترنت والاتصالات، أو أحداث القوة القاهرة الأخرى. وستستأنف التزاماتنا في أقرب وقت ممكن عملياً بمجرد انتهاء الحدث. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet or telecommunications failures, or other events of force majeure. Our obligations will resume as soon as reasonably practicable once the event has ended.

١٠. التعديلات على هذه الشروط 10. Modifications to These Terms

قد نقوم بتعديل هذه الشروط من وقت لآخر. وإذا أجرينا تغييرات جوهرية، فسنقوم بإشعارك عبر التطبيق و/أو البريد الإلكتروني وتحديث تاريخ "آخر تحديث" أعلاه قبل دخول التغييرات حيز التنفيذ. استمرارك في استخدام الخدمة بعد تاريخ السريان يعد موافقة منك على الشروط المعدلة. We may update these Terms from time to time. If we make material changes, we will notify you through an in-app notice and/or by email and update the "Last updated" date above before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

١١. استقلالية البنود والتنازل 11. Severability and Assignment

إذا وجد أي بند من هذه الشروط غير صالح أو غير قابل للتنفيذ من قِبل محكمة مختصة، فإن البنود المتبقية ستظل سارية المفعول وبكامل أثرها. يجوز لنا التنازل عن هذه الشروط أو نقلها، كلياً أو جزئياً، في إطار دمج أو استحواذ أو بيع أصول؛ ولا يجوز لك التنازل عن حقوقك أو نقلها بموجب هذه الشروط دون موافقة خطية مسبقة منا. If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions will continue in full force and effect. We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, or sale of assets; you may not assign or transfer your rights under these Terms without our prior written consent.

١٢. القانون المعمول به وتسوية النزاعات 12. Governing Law and Dispute Resolution

تخضع هذه الشروط وتفسر وفقاً لقوانين المملكة العربية السعودية. ويخضع أي نزاع أو دعوى تنشأ عن هذه الشروط أو تتعلق بها أو باستخدامك للخدمة للاختصاص القضائي الحصري للمحاكم المختصة في مدينة الرياض بالمملكة العربية السعودية. These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute or claim arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Riyadh, Kingdom of Saudi Arabia.
